1. Legal Preamble & Agreement to Terms

Welcome to the digital flagship of Magic Hair Oil. By accessing this storefront, registering a client account, or submitting a purchase order, you unconditionally agree to be legally bound by these Terms of Service.

These terms govern all transactions, digital interactions, and product distributions operated under the management of Babar Dogar, headquartered at Ghous Garden Phase 3, Lahore, Punjab, Pakistan. If you do not accept these terms in full without modification, you are strictly prohibited from utilizing this platform or submitting purchase requests.

2. Official Pricing Covenant: MRP Ceiling & MAP Floor

To eliminate predatory pricing, protect end-consumer equity, and preserve certified wholesale salon margins, all Magic Hair Oil formulations operate under strict price boundary covenants across Pakistan:

Our active commercial catalog is centered exclusively on our single flagship formulation: Magic Hair Oil Botanical Elixir (200ml luxury applicator bottle with precision scalp dropper).

• Fresh Cold-Pressing Guarantee: Every consignment dispatched from our Lahore Central Logistics Hub at Ghous Garden Phase 3 contains unrefined botanical lipids cold-pressed under zero-heat standards below 40 degrees Celsius. Batches are produced in limited cycles to ensure maximum biological potency.
• 100% Pure Botanical Lipids: Formulated exclusively with food-grade virgin olive oil, cold-pressed castor, whole black seed (kalonji), fresh amla, and mountain rosemary essential oils. Completely free from liquid paraffin, mineral oils, synthetic perfumes, silicones, and artificial colorants.

4. Domestic Offer & Contract Formation

Submitting an order via our online checkout constitutes an offer to purchase. A legally binding contract of sale is formed only when all of the following criteria are met:

1. The customer provides verifiable delivery coordinates located within the territorial boundaries of Pakistan.
2. Our verification desk confirms the order details via telephone, WhatsApp message, or automated confirmation.
3. Our logistics operations team generates a verified domestic tracking waybill code through Leopards Courier Service (LCS).

We reserve the right to decline, hold, or cancel any order suspected of fraudulent intent, bot-driven automated submissions, suspicious telephone patterns, or unauthorized reselling attempts.

5. Approved Payment Rails & Remittance Structure

To streamline customer convenience while preventing transactional fraud, we provide two transparent settlement options across Pakistan:

All settlement methods settle at the exact net invoice total. We do not levy hidden processing surcharges or payment method fees.

6. Pre-Payment Verification & Proof of Transfer

When selecting Direct Bank Transfer or Mobile Wallet remittance:

• Remittance Deadline: Payment confirmation must be remitted within 24 hours of order placement. Unverified orders will be canceled and inventory released back to the general pool.
• Proof of Transfer Intake: Customers must upload a legible screenshot of the debit confirmation receipt or provide the valid Transaction ID (TID) through our order completion terminal or WhatsApp support desk (0328 4845753).
• Account Title Verification: Remittances sent to any accounts other than those officially published under the title Kainat Babar are invalid and will not be honored.

7. Logistics SLA, Dispatch Schedules & 100% Free Delivery

All physical orders are packaged in heavy-duty tamper-evident cartons at our Lahore Central Logistics Hub at Ghous Garden Phase 3:

• 100% Free Nationwide Delivery: Every order, regardless of quantity, qualifies for 100% Free Nationwide Delivery via Leopards Courier Service (LCS) with zero shipping charges (Rs. 0.00).
• Domestic Courier Partner: All domestic deliveries are handled via Leopards Courier Service (LCS) with end-to-end tracking waybills.
• Delivery Timeline: Standard domestic delivery takes 2 to 3 business days to major urban centers (Lahore, Karachi, Islamabad, Rawalpindi, Faisalabad, Multan, Peshawar, Quetta, Gujranwala, Sialkot) and 3 to 4 business days to regional districts.
• Same-Day Dispatch Cut-Off: Orders confirmed prior to 3:00 PM PKT Monday through Saturday dispatch the same business day. Sunday orders dispatch on Monday morning.
• Studio Pickup: Customers in Lahore may opt for Self Pickup at our Ghous Garden Phase 3 studio with zero collection charges (ready in 2 hours).

8. Cash on Delivery (COD) Compliance Covenant

Cash on Delivery is a service of trust provided to facilitate genuine customers across Pakistan. By placing a COD order, you make a legally binding commitment to accept the parcel upon arrival:

• Payment on Hand: You agree to ensure that an authorized recipient is present at the delivery address with the exact invoice cash amount ready when the LCS rider arrives.
• No Inspection Before Payment: Under standard courier regulations in Pakistan, courier delivery riders are strictly prohibited from allowing customers to tear open sealed flyers or product boxes prior to handing over the cash amount. Packaging inspection occurs immediately after payment handover.
• Liability for Frivolous Refusals: Refusing delivery without verified exterior transit damage causes dead freight financial losses. Customers who make frivolous refusals will have their phone numbers and addresses permanently blacklisted from Cash on Delivery across our nationwide logistics network.

9. Client Accounts, Passwords & Security Discipline

Customers may access their Client Portal via either their configured Email Password or our secure 6-Digit One-Time Passcode (OTP) and Magic Link gateway. You are responsible for safeguarding your login credentials. If you suspect unauthorized access to your account, you must immediately reset your password via our automated reset portal or contact our care desk at hello@magichairoil.com.

10. Salon Wholesale Sourcing & Commercial Stockist Program

Commercial salons, barber studios, and aesthetic clinics may procure case quantities subject to our strict wholesale covenant:

• Maximum Trade Concession: Wholesale discounts are strictly structured based on verified case volumes from Tier I (10%) up to a maximum cap of Tier IV (20% maximum discount).
• Price Maintenance Obligation: Stockists must never offer retail resale to end-clients below our MAP floor (Rs. 1,499.00) or above our MRP ceiling (Rs. 1,899.00).
• Territorial Integrity: Wholesale accounts are authorized for direct studio application and storefront retail display. Reselling across third-party marketplaces without prior written authorization is strictly prohibited.

11. Intellectual Property & Anti-Counterfeiting

"Magic Hair Oil", "MHO", our botanical formulation blends, label artwork, digital assets, trademarks, and educational journal monographs are the exclusive intellectual property of Babar Dogar and Magic Hair Oil Core.

Counterfeiting, unauthorized rebottling, dilution, synthetic substitution, or unauthorized utilization of our imagery and trademarks constitutes criminal trademark infringement actionable under the Trade Marks Ordinance 2001 and Pakistan Penal Code.

12. Regimen Advisory & Disclaimer of Medical Warranties

Magic Hair Oil Botanical Elixir is a traditional 100% pure botanical hair and scalp therapy elixir handcrafted from cold-pressed virgin plant lipids and herbs.

• Cosmetic Classification: While our botanical actives (rosemary, kalonji, amla, castor) are backed by published ethnobotanical literature, this product is not a pharmaceutical drug intended to diagnose, treat, cure, or prevent underlying autoimmune pathologies (such as severe alopecia totalis or systemic endocrine disorders).

13. Limitation of Liability & Indemnification

To the maximum extent permissible by Pakistani law, Magic Hair Oil, its founder Babar Dogar, operators, logistics officers, and affiliates shall not be liable for any indirect, incidental, punitive, or consequential damages resulting from improper application, allergic reactions arising from known user allergies, or courier delays caused by external weather and road blockages. Our total aggregate liability for any direct claim shall never exceed the purchase price paid for the individual bottle in dispute.

14. Force Majeure & Delivery Disruptions

We shall not be held liable for failure or delay in fulfilling our delivery commitments where such failure arises from circumstances beyond reasonable human control, including but not limited to: monsoon flooding, highway blockades, regional internet blackouts, public strikes, provincial transport shutdowns, or severe natural disasters.

15. Governing Law & Legal Jurisdiction

These Terms of Service and all related agreements shall be governed by, interpreted, and construed in accordance with the substantive laws of the Islamic Republic of Pakistan, including the Contract Act 1872, the Sale of Goods Act 1930, and the Pakistan Electronic Crimes Act (PECA 2016). Any legal suit, controversy, or dispute arising out of or related to these terms shall be submitted to the exclusive jurisdiction of the competent civil courts located in Lahore, Punjab, Pakistan.
